The trial of a lawsuit in which the factual questions are presented to, and the final judgment is determined by a jury, is a constitutional right of every American. Such trials are available in all cases in which a person's liberty or substantial property rights are at risk. They are not available in bankruptcy, maritime, administrative or small claims proceedings. The trial of a lawsuit in which the factual questions are presented to, and the final judgment is determined by a judge is often referred to as a bench trial. Such trials are available in all cases in which a person's other property rights are at risk.
